Surprising ruling of the Court in Leeuwarden on poker
on 2 July 2010 decided the Court in the Hague that poker (Texas Hold'em variant) of the law on games of chance could be regarded not as a game of chance, but as a skill game. Last week (14 October 2010), the Court Leeuwarden in an unpublished judgment reported that this variant of poker as a game of chance is to be considered. The Court Leeuwarden case concerned a tax issue, while the Court in the Hague ruling a criminal case concerned.
Against the decision of the Court in the Hague is an appeal by the ORDER. Is not yet known or even against judgment of the Court in Leeuwarden will be appealed. The appeal period shall expire on 26 november 2010.
A bright spot for the poker players is that Court Leeuwarden ruled that the position of the poker player that poker is not gambling was, baar; There can thus be no penalty imposed. "

Op 2 juli 2010 besliste de rechtbank in Den Haag dat poker (de Texas Hold'em variant) voor de wet op de kansspelen niet beschouwd kon worden als een kansspel, maar als een behendigheidsspel. Vorige week (14 oktober 2010) heeft de rechtbank Leeuwarden in een nog niet gepubliceerde uitspraak gemeld dat deze variant van poker wel als een kansspel beschouwd moet worden. De rechtbank Leeuwarden zaak betrof een fiscale kwestie, terwijl de rechtbank Den Haag uitspraak een strafzaak betrof.
Tegen de uitspraak van de rechtbank Den Haag is door het OM beroep aangetekend. Nog niet bekend is of ook tegen uitspraak van de rechtbank Leeuwarden beroep aangetekend zal worden. De beroepstermijn loopt af op 26 november 2010.
Een lichtpuntje voor de pokerspelers is dat rechtbank Leeuwarden oordeelde, dat het standpunt van de pokerspeler dat poker geen kansspel was, pleitbaar is; er kan aldus geen boete opgelegd worden."

I think its a bit of both chance and skill. A skilled poker player can win against noobs easily. But when the sill level is at the same hight, chance becomes more important.

definitely both... but in my opinion; its more on skill... this is the reason why most of the pro's were very successfull... they have the skills and talent to play it...
