I agree. It's very common that if you have bonus money in your account, there's some kind of cashout restrictions - also if you feel it's your own money trying to cashout. I suppose this is also to prevent certain users exploiting offers like "deposit and get to play in this freeroll", where they would deposit, play the freeroll, then cashout again.
We would love for all our members to make money playing poker, but we also cannot run a business with free money if people doesn't play
As the site I run commits fraud I assume you will no longer want to play on the site?
If this is the case i will remove the $40 bonus money as you say it is untouched, and i will then pay out the $28 to you today and close the account.

I think the confusion lies in the fact that those terms and condition APPEAR to refer to cashing out the $40 free money placed in the account.
It does not mention anything about ALL future deposits and wins which are mide over and above the $40.
If I were to take the $40 bonus then deposit $200 and turn that into $1000 I cannot then withdraw the $1000 until I have cleared 450 POP points. OK its in the terms and conditions, but its not clear that the 450 must be gained for ALL monies, not just the $40 free money.
The allegation that it is fraud is completely unfounded and wrong. However the terms and conditions are misleading and are such that they portray you have to earn 450 POP to withdraw the $40 free money. This isnt the case. If you deposit over and above the $40 and win you still cannot touch that money.
Perhaps a clearer statement saying that if you take the $40 no deposit bonus then you cannot cash out AT ALL until you have cleared 450 POP points.
In short, he is wrong for making a false allegation, but likewise your company is at fault for not making the T+Cs clearer.
Sites like yours claim the moneys are a NO DEPOSIT BONUS when in fact this is incorrect because unless you make a deposit you cannot do anything with the money. No matter how many POP points you gain. You can turn the $40 into $1 million but unless you make a deposit that money is worthless, thus you could argue its not a no deposit bonus at all. Its simply a chance to build up a bankroll BEFORE you do make a deposit.

Well the thing is that someone paid you that 40 $ and no matter what if you just let them sit that someone has lost 40 $, so if you don't want to play through your bonus on the site that you requested your no deposit bonus you shouldn't deposit on said site, pretty obvious to me, but I do think like Shaun and Action Poker just proved that any site would be more than helpfull in making you satisfied if you just approach them nice and calm and ask why you can't cash out, instead if immediatly accusing people of this and that.

If you state, that this or that has to happen, then you have to stick to it. If you do NOT STATE, that the 450 POP are necessary to take ANY CASH OUT, then you can not apply this rule. ONLY WHAT IS WRITTEN DOWN COUNTS.

that was a owngoal fcumred. 450pop is easy to earn...what was your purpose on depositing $30 and cashout again within hours guess that what admin mentioned ?

The reason fo rteh deposit is easy to understand he want to play the private $1k tourney, he won $3 and then wanted to cash the $3 out plus his $25 which I have allowed to do, i have also now removed the bonus funds from the account, what would have made more sense is to work the bonus grind to 450 pop and cash out a load more money.
Anyway what can you do.

Let me get this straight - and no offence intended to the user - he gave up his $40 in order to get $28, so he actually lost $12 doing it? I think I would have played for the 450 pop instead if it was me

1. He got his free cash
2. He then saw an email about the $1k tourney
3. Made a deposit of $25 to player - did not even spend $1 playing poker
4. He won a whole $3 in teh tourney
5. He then wanted to cash out his deposit and his $3 winnings
6. Did not use 1 cent of the free money

they give u freemoney of course there going to put restrictions on you i cleared both bonuses 50 and 50 and have a bankroll of 500 usd that is in one day if u cannot clear 450pp there is something wrong with u i suggest u play 50/1 nl holdem or pot limit till u earn the required points good luck

And to comment on the topic too.. Whatever the issue is.. to go and accuse any room of fraud without any grounds is just plain STUPID. Too bad he got his account closed.. I bet he would've been a real money making machine at the tables.
