Boyd Gaming Fined $300K for Wrongful Detention of Slots Player in their Casino

The Nevada Gaming Control Board (NGCB) has slapped Boyd Gaming with a whopping $300,000 fine for the wrongful treatment and arrest of a slot player accused of stealing another player's credits in their Fremont Hotel & Casino branch.

Guilty first until proven innocent

The incident happened last year, November 24, 2019, a little after midnight.

There were two women playing slots side by side. The first woman was seen on surveillance video at a slot machine playing, cashing out, and then moving away. The second woman then went to play on the same machine where the first patron played, but then the latter came back and accused the other of stealing money she left on the machine, about $202.

Instead of calmly conducting an investigation, a security guard harshly grabbed the accused slots player by the arm and neck, handcuffed her, and for 90 minutes was detained in a side room. The woman tried to clear her name that entire time but the security officer berated her, not listening to anything that she says.

According to Nevada deputy attorney general Ed Magaw, the guard also screamed at the poor woman, threatened to put her in jail, and was forced to give money that belonged to her. The officer was "harsh and overly hostile", he said.

The woman eventually gave up $202 of her own cash to the casino so that she could finally leave the downtown Las Vegas gaming property.

The $202 was then given to the patron who accused the woman of theft. Later, that same patron was seen on CCTV footage cashing out a voucher from her pocket for $202.

According to the alleged complaint lodged by the wrongfully accused patron, receipts from the slot machine and surveillance show that the woman lied about being stolen from. The complaint also said, "Other Fremont personnel, including surveillance and slot personnel, were also negligent in interpreting the available video and relevant slot reports that, if examined properly, would have exonerated the accused patron."

These horrible actions were reviewed by the NGCB and on Thursday, September 24, NGCB Chairman John Moran Jr. said he was "very troubled" about the incident. He decided to "reluctantly support" the complaint settlement, saying the amount was quite low.

Higher penalties in future

The NGCB filed a four-count complaint against the downtown Las Vegas casino for allegedly detaining a woman for theft despite evidence showing she did not commit a crime. The complaints were:

  • wrongful detention of a patron
  • wrongful taking of funds from a patron
  • sharing incorrect information with the LVMPD
  • sharing incorrect information with the NGCB

Moran also gave a stern warning to other casinos and gambling companies that they better avoid doing the same to their patrons, emphasizing in the future that the penalties will surely be higher.

He said, "I am not going to support only a $300,000 fine. It's going to be a lot more."

Executive VP for operations at Boyd Gaming Steve Thompson told the commissioners that "embarrassment is not a strong enough word" to describe how their company officials felt about the incident. He said, "The security officer failed at almost everything he was trained upon."

Based on a review made by a Boyd security chief, Thompson said, "We had an officer who went into hero mode instead of doing his job." That security officer and other casino officials also failed to properly review surveillance footage and slot machine records that day.

Three days later after it happened, the mistreated player called the company's hotline and reported her horrible experience. It then took many days more for the info to reach Boyd's internal compliance staff, and along with other officials, they conducted their own review. They then contacted the wrongfully accused player and Boyd's board members were informed. The company then self-reported the incident to NGCB officials.

Boyd settles, paying $300K without acknowledging responsibility

Boyd's attorney and a former NGCB chairman A.G. Burnett told the NGC that false information was initially reported to NGCB agents and Las Vegas Metro Police officers that night. Casino officials and employees also disputed the claim and the NGC meeting.

Because of that incident, Boyd Gaming has modified its company-wide policies on detainment, arrests, and use of handcuffs. Also, a casino manager must also be consulted before security officers can detain a guest.

Thompson reported to the Nevada Gaming Commission, "We have settled with the patron."

The Fremont Hotel & Casino was also fined $300,000 for the alleged violations. As part of the settlement, the hotel-casino naturally did not admit to the allegations of the misconduct.

as I see from whole news,they made big mistake,they had women for 90 minutes for nothing and now they will pay lot of money for this mistake!you cant accuse somebody without any evidence and to grab her on neck and arm!you can see how everything finish very fast,less then year!that is what I love in america,you have your right,not like in other countries!

This officer as the news say went instantly into hero mode , arrested and handcuffed her . All these for the incredible (lol) amount of $202 , which the otherwoman left/forgot Question behind , then returnd back accusing the poor lady . This officer didn't do his job right towards a weak lady , he should have conducted a better investigation , informed his superior manager that night , regardless of the insignificant amont of the stolen money .

This was an ugly abuse by the security officer because some people think they are all-powerful and are ready to punish without thinking. Now he must overcome some consequences and deserve to be dismissed from his job. Casino pays for its sins.

you can imagine what he would do if there was bigger amount in the game and how many hours she would spend in this room!I know that he need to react if somebody say that she took money from her,but you cant do something like this!now everybody will think twice when they will be in this situation!

Many people do not respect the laws and they abuse. That means democracy is disappearing because in 2020 we made many cases where people suffered. Police or gendarmes they hurt citizens and now it's turn of guards security.

I can understand the frustration of the lady who accused the othe poor lady of theft , so many hours of playing and losing , and sddenly win some money back of the total money you have played , invested on the game might blur your mind and start saying nonsense .

But the security guard should have been more carefull , more experienced , more prepared to deal with this kind of situations .

I do not know the status of the accusing lady , because he believed hes instantly , was she so important , a rich , a well known to the casino owner or the manager or to the employees there ??? It's seriously strange that he started berating thepoor accused woman so easily .

It is good that justice is done, so that the same mistake is not made again, they should apologize to the client, I imagine how he would have felt that day, ..

thats why you need to react on normal way and first to ask every person whats happend and who is guilt,not just to attack somebody just because you are security man!you need to listen both sides and to solve this problem on normal way,especially if this person isnt agressive!now he will probably lose his job and casino will pay this amount to women!

Nevada Gaming Control Board has been elected with $ 300,000 due to an abused woman. Now i am curious what amount of compensation the victim will receive, because consider that it must be higher than that fine. Anyway, guard is very guilty.

In the news it didn't say he lost his job ,
I don;t think they officially recognised their responsibility 100% for this incident , ofcourse this is a practice everywhere and everytime , a compromise , or else the victim would come and would ask millions and millions , not one victim , every victim from all last years , for every casino , a destruction .

These mistakesd happen . He must lose his job , I am not happy to say , but this shoud be done , as an example for other security guars , who in the US have a lot of power and right on civilians (hundcuff them , sometimes even shoot them !!) , so they will restrain themselves for their own good and te good of their casino where they work . Cause if they get fired , the word will spread , no casino or similar business will hire them

I read again the news . the good thing to mention , is that the casino itself let the NGCB know of the incident , after the lady phoned them and complained and some days passed with delay and a research took place and they found out that something actually might have gone wrong .

So , they didn't try to hide the inciden't .
That's very nice and honourable on behalf of them . I wonder why . Does NGCB have very strict penelaties if it finds out that a casino has tried to hide an incident ??
I guess so , or else there is no meaning , this thruthfulness makes me almost wanna cry , lol , like saying , pls , I might have made a mistake , If So Do Punish Me , Masochism At Its Peak , or Maybe Retardness ??

they know that they will pay on end and that they cant hide this!in america you have right as citizen and every court will be on your side,especially when you get physical contact and you didnt done anything!with this case other casinos will learn how to react and how to treat players on their ground!

As long as the laws are not so solid for the population, some people do harm to others. Threats, abuses, brutality, beatings etc... Security guard needed to know that he cannot do this thing. I would like as he to pay a lot for it.

dule vu , I think in America it's both srories true , yes if they learn it they will impose more strict penalties but on the other hand security guards have a lot more powers , enforce rights on citizens , if or when an incident , even very small takesplace where they work , here in Europe , in most countires it's different , the opposite I would say , the security guards have to call the police to arrest sb , only in extreme cases they can do sth themselves
Anyway , also in some cases if the customer is poor , I believe the end of the story will be the same or worse as in europe , he will be treated very bad in such an occasion if a known to the casino customer or rich customer accuse him of cheating .

If sb is losing money all the time , all night , or if he loses and wins very ilittle suddenly , he's ready for a fight anyway , either a man or woman , casinos have security personel for that reason also , they have to be trained vey well and do their job accordingly .

Security officer & other supervisors did not proceed correctly to follow all cameras from the casino and that means they were semi-amateurs or something identical. It's a shame to proceed so ugly, This woman must claim beautiful damages...

probably they have bigger powers then secutiry guard in europe,especially in this big casinos,but they also need to be careful how they will react,as you can see in this case!we all know how security guards can react on balkan,they will fight with anybody,especially in night clubs!
but when you do something like this in america,people have bigger rights then in other countries and you can see how much they will need to pay for it!

They are not allowed to abuse people. When police arrest you, don't beat like in the past. People have rights in America and that security guard was probably nervous about another reason... that's why preferring that behavior.

I know that americans have some special laws and that companies need to publish every terms,because they dont want to allow that somebody sue them!like that they need to have warning on hair dryer that you cant use it in water!but when things like this are in question or when somebody come without your permision in house and you can kill him,thats laws that respect at them!

that justice be done and it is good that they have fined the casino, since they do not have the right to attack or treat someone badly and much less when they do not have strong evidence to treat them that way, sometimes you have to go to justice so that our rights are respected wherever we are.

The law is not respected nowadays. Politicians in my country, gendarmes, police, doctors or nurses made one abuse after another. Each has violated the constitution thousands of times and that's because of ''black money'' from european union under the pretext of covid. In this way this security guard proceeded. Very bad for all.
